FineMe is operated by OMGHey LLC (“FineMe,” “we,” “us,” or “our”). This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information when you use the FineMe application, tryfineme.com, and related services (the “Service”).
This policy is designed to describe the Service as currently planned. Our App Store privacy disclosures and in-app permission prompts must match the data actually collected by the released build, including data collected by third-party software development kits.
1. Information We Collect
Account and contact information. Name, email address, login credentials or authentication identifiers, age or confirmation that you are at least 18, profile details, settings, and communications with us.
Challenge information. Goals, challenge type, schedule, selected consequence amount, completion or failure status, streaks, check-ins, evidence you submit, review requests, and challenge history.
Health and fitness information—with your permission. Depending on the features you use, this may include step count, workout type and duration, sleep duration or schedule, wake-time indicators, and related measurements obtained from Apple Health/HealthKit or supported health and wearable services. FineMe requests only data reasonably necessary for the selected feature.
Device activity and screen-time information—with your permission. Depending on operating-system capabilities, this may include selected app or category usage, aggregate screen-time duration, device activity needed to verify a limit, and authorization status. Where Apple’s frameworks provide privacy-preserving or shielded results rather than underlying activity, we receive only the information made available through those frameworks.
Alcohol-free and nicotine-free challenge information. Your goal selection, self-reported check-ins, supporting evidence you choose to provide, and completion status. This information can reveal sensitive health or lifestyle information.
Payment and transaction information. Consequence amount, payment status, processor customer or payment-method token, limited payment-method details such as brand and last four digits, chargebacks, refunds, and billing history. Full card numbers are collected and processed by our payment processor, not stored directly by FineMe.
Friends and social information. Connections, invitations, selected profile details, shared goals or progress, reactions, reports, blocks, and content you choose to share.
Device, usage, and diagnostics. Device and app version, operating system, language, time zone, general location derived from IP address, IP address, identifiers, log data, feature interactions, crash reports, performance data, security events, and consent or permission status.
Communications. Messages to customer support, survey responses, feedback, and any attachments you send.
We do not intentionally collect precise location, contacts, photos, camera, microphone, or other sensitive data unless a specific feature clearly requests it and this policy and the relevant permission prompt are updated before collection.
2. How We Collect Information
We collect information directly from you; automatically from the app, device, and website; from Apple frameworks after you grant permission; from supported wearable or health services you connect; from payment processors; and from other users when they invite, connect with, report, or interact with you.
3. How We Use Information
We use personal information to: create and secure accounts; configure and verify challenges; determine completion under disclosed rules; process authorized consequence charges, refunds, and disputes; display progress and social features you choose; send service, safety, and support communications; troubleshoot and improve reliability; prevent fraud, manipulation, abuse, and security incidents; comply with law and enforce our agreements; and create aggregated or de-identified insights that are not reasonably linkable to an individual.
We do not use Apple Health/HealthKit data, health or fitness information, screen-time data, alcohol-free information, or nicotine-free information for third-party advertising, marketing based on health status, credit or insurance eligibility, employment decisions, or sale to data brokers.
We do not use personal information to make decisions producing legal or similarly significant effects without providing any notice and rights required by law.
4. Legal Bases for Processing
Where applicable law requires a legal basis, we process information to perform our contract with you; with your consent, including for device permissions and connected health services; for legitimate interests such as security, support, fraud prevention, and product improvement where those interests are not overridden by your rights; and to comply with legal obligations. You may withdraw consent through device or account settings, but withdrawal does not affect prior lawful processing and may prevent a feature or challenge from working.
5. Health and Sensitive Information
We treat health, fitness, device-activity, alcohol-free, and nicotine-free information as sensitive. Access is permission-based and limited to purposes reasonably necessary to provide the feature you select, maintain security, resolve disputes, and comply with law.
You can revoke Apple Health or other device permissions in your device settings. Revoking access stops future collection through that permission but does not automatically delete information already received. You may request deletion as described below. If you revoke a required permission during an active challenge, FineMe may be unable to verify completion; the effect will be disclosed in the challenge rules before enrollment.
FineMe does not write health information to Apple Health unless a feature expressly tells you it will do so and obtains the required permission.
6. How We Disclose Information
Service providers. We disclose information to vendors that help with cloud hosting, authentication, payment processing, customer support, email delivery, analytics, crash reporting, fraud prevention, security, and professional services. They may process information only for contracted purposes and subject to appropriate protections.
Connected services. When you direct us to connect Apple Health, a wearable platform, or another integration, information is exchanged as needed to provide that connection and subject to the provider’s terms and permissions.
Friends and other users. We disclose only the profile, challenge, progress, or activity information you choose to make visible through the available sharing settings. We do not disclose raw Apple Health records to friends unless a feature clearly asks you to share a specific item.
Legal, safety, and compliance. We may disclose information when reasonably necessary to comply with law or legal process, protect rights and safety, investigate fraud or abuse, enforce agreements, or respond to an emergency.
Business transactions. Information may be disclosed in connection with due diligence, financing, merger, acquisition, reorganization, bankruptcy, or sale of assets, subject to confidentiality and applicable law.
At your direction. We disclose information when you request or consent to it.
We do not sell personal information for money. We do not sell or share health or sensitive information for cross-context behavioral advertising. If our practices change in a way that creates a legal right to opt out, we will provide the required notice and control before doing so.
7. Advertising and Analytics
FineMe does not use health, fitness, screen-time, alcohol-free, or nicotine-free information for advertising. If we use analytics or crash-reporting tools, they must be configured to collect only the data described in this policy and in our App Store privacy disclosures.
We will request AppTrackingTransparency permission before any activity that Apple defines as tracking. If the released app does not request that permission, FineMe does not engage in tracking as defined by Apple. You can manage relevant permissions in iOS settings.
8. Retention
We retain information only as long as reasonably necessary for the purposes described here. Account and challenge information is generally retained while your account is active. After deletion, we delete or de-identify it within a reasonable period unless retention is needed for payment records, taxes, accounting, fraud prevention, safety, disputes, legal holds, or compliance.
Transaction and charge records may be retained for up to seven years or longer if required by law. Security and diagnostic logs are generally retained for a shorter period appropriate to their purpose. Backup copies may persist for a limited period before being overwritten. When retention is no longer necessary, we delete, de-identify, or securely isolate the information.
9. Your Choices and Rights
Account settings. You may update available profile and sharing settings in the Service.
Permissions. You may grant or revoke health, device-activity, notification, tracking, and other permissions through your device settings. Some features may stop working if a required permission is revoked.
Communications. You may opt out of promotional email using the unsubscribe link. We may still send transactional, security, legal, and account messages.
Access, correction, deletion, portability, and restriction. Depending on where you live, you may request access to, correction or deletion of, or a copy of personal information; restrict or object to certain processing; withdraw consent; or appeal a denied privacy request.
To submit a request, use the in-app account-deletion or privacy controls, if available, or email support@tryfineme.com. We may verify your identity and authority before acting. Authorized agents may submit requests where permitted by law, subject to verification. We will not discriminate against you for exercising privacy rights.
Deletion of an account does not automatically reverse a properly triggered charge or require deletion of records we must lawfully retain. We will explain any applicable exception.
10. U.S. State Privacy Disclosures
Residents of states with applicable comprehensive privacy laws may have rights to know or access, correct, delete, and obtain a portable copy of personal information and to opt out of certain sale, targeted advertising, sharing, or profiling. As described above, we do not sell personal information for money or sell/share sensitive health information for targeted advertising.
For California residents, the categories collected during the preceding 12 months may include identifiers; customer records and payment information; commercial information; internet or electronic activity; approximate geolocation; user content; inferences such as challenge status; and sensitive personal information, including health and lifestyle information you choose to use with the Service. We collect, use, retain, and disclose these categories for the business purposes described in this policy. We do not use sensitive personal information to infer characteristics beyond what is reasonably necessary to provide the requested Service, maintain security, or comply with law.
You may appeal a privacy-request decision by replying to our response with “Privacy Appeal.” You may contact the appropriate state regulator if an appeal is denied and applicable law grants that right.
11. Security
We use administrative, technical, and physical safeguards designed to protect personal information, including access controls, encrypted transmission where appropriate, vendor controls, and monitoring. No system is completely secure. You are responsible for protecting your credentials and device and for notifying us promptly of suspected unauthorized use.
12. Children
The Service is only for people age 18 or older. We do not knowingly collect personal information from children under 13 or knowingly allow anyone under 18 to create an account. If you believe a child provided information, contact support@tryfineme.com so we can investigate and delete it as appropriate.
13. International Use and Transfers
FineMe is operated from the United States. If you access the Service from another country, information may be transferred to and processed in the United States and other countries where our service providers operate. Where required, we use recognized transfer safeguards and provide rights required by local law.
14. Third-Party Links and Services
Third-party services have their own privacy practices. This policy does not govern Apple, payment processors, wearable providers, websites linked from the Service, or other third parties. Review their policies before connecting or providing information.
15. Changes to This Policy
We may update this policy as the Service or law changes. We will post the revised policy and update the effective date. If changes are material, we will provide additional notice as appropriate and obtain consent where required. We will not materially expand the use of previously collected health or sensitive information without the notice or consent required by law and platform rules.
